Terms of Service

1. Seller and Acceptance

Shared Memorial is operated by Uncapp BV, a company registered in the Netherlands ("we", "us", "Uncapp BV"). By accessing or using Shared Memorial ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not access the Service.

2. Description of Service

Shared Memorial provides a private online space for families and close friends to gather, share and preserve photos and videos of loved ones who have passed away. The Service includes upload, storage, commenting and moderation features.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Content and Conduct

You retain ownership of any content you upload. By uploading content, you grant Uncapp BV a limited, non-exclusive licence to host, display and transmit it solely to operate the Service.

You may not upload illegal, hateful, threatening, sexually explicit, or copyright-infringing material, and you may not use the Service to send spam, malware, or interfere with its security. We may remove content or suspend accounts that violate these rules.

Fair use, storage and viewing limits

Each plan includes a storage allowance and a monthly viewing-traffic allowance (Keepsake 10 GB, Family 50 GB, Legacy 200 GB of traffic per month per memorial). Uploads stop when the storage allowance is reached. When the monthly traffic allowance is reached, we may serve photos at a smaller size, pause video streaming and downloads until the first day of the next month, and require anonymous visitors to sign in; signed-in members keep normal access. We warn the memorial owner by email at 80% of the allowance and again when it is reached, and extra storage or traffic can be purchased at any time. In exceptional cases, and where reasonably possible only after notice, we may throttle, require sign-in for, or suspend serving of a memorial to protect the availability and cost of the service for all users.

6. Intellectual Property

Uncapp BV retains all rights, title, and interest in the Service, including its software, design, and branding. These Terms grant you a limited, non-transferable right to use the Service within your chosen plan; no other rights are granted by implication.

7. Privacy

Memorials are private by default. Only invited contributors and viewers can access content. We do not sell your personal data or the content you upload. See our Privacy Notice at /privacy for full details on how Uncapp BV handles your data.

8. Payment, Billing and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

One-time plans include hosting for up to 10 years from the date of purchase. Subscription plans renew automatically until cancelled. Prices are shown in Euro; Paddle calculates and collects any applicable taxes at checkout. 9. Refunds

10. Suspension and Termination

You may delete your account and memorials at any time. We may suspend or terminate access for material breach of these Terms, non-payment, security or fraud risk, or extended inactivity on unpaid accounts.

11. Warranties and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, to the fullest extent permitted by law. Uncapp BV's aggregate liability for any claim is limited to the fees you paid in the twelve months preceding the claim, and we are not liable for indirect, incidental or consequential damages. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
